1. Acceptance of Terms
By registering as a designer on Highlypookie ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
2. Intellectual Property & Ownership
- Designer's Art: You retain 100% ownership of the artwork you upload. You represent and warrant that the artwork is your original creation and does not infringe upon any third-party intellectual property rights.
- License to Highlypookie: By uploading your art, you grant Highlypookie a non-exclusive, royalty-free license to use, display, reproduce, and sell your designs on our products through our store and partner channels.
- Proprietary Content: All Platform features, software, and brand assets are the exclusive property of Highlypookie.
3. Designer Obligations
You agree to:
- Provide accurate personal and bank information for payouts.
- Not upload any content that is offensive, illegal, or violates Indian community standards.
- Comply with ASCI guidelines if you promote your products on social media.
4. Commission & Payments
- Commission Rate: Designers earn 60% of the gross margin (Selling Price minus Base Cost).
- Payout Cycle: Payouts are processed on the 1st and 16th of every month for cleared earnings.
- Taxes: Highlypookie will deduct applicable TDS (Tax Deducted at Source) as per the Indian Income Tax Act before transferring commissions.
5. Termination
Highlypookie reserves the right to suspend or terminate your account if you violate these terms or if your designs are subject to copyright claims. You may delete your account at any time, which will revoke our license to sell new products featuring your art.
6. Dispute Resolution
These terms are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in [Your City, State], India.
